Police are currently investigating a robbery and shooting that occurred at a South Brunswick gas station recently.

The aforementioned incident occurred at the BP Gas Station on Route 27 and Alston Road in Kendall Park, South Brunswick. Police say a tan or light brown SUV approached the gas station from Route 27 South at approximately 4:15 a.m. on October 15th.

According to police, There were at least two suspects, one of whom was a black male who concealed part of his face. He reportedly exited the SUV and attempted to rob the station while armed with a gun. The attendant was shot multiple times and subsequently hospitalized. After shooting the attendant, the assailant reportedly fled the scene in the SUV with at least one other suspect.

The 60-year-old attendant was taken to Robert Wood Johnson University Hospital in New Brunswick for emergency medical treatment. The investigation into the robbery and shooting is ongoing, as police say they are pursuing a number of leads. They just released additional information regarding the incident and have requested the public’s assistance in identifying the car used during the commission of the crime.

If investigators ultimately identify one or more suspects, they may face charges for robbery, possession of a weapon for an unlawful purpose, and aggravated assault. Considering the egregiousness of these crimes, the defendant(s) would be exposed to severe penalties.

For example, robbery alone is a first degree crime in New Jersey when the actor is armed with, uses, or threatens to use a deadly weapon (N.J.S.A. 2C:15-1). A conviction for robbery entails a prison term ranging from 10 to 20 years, 85 percent of which must be served before the person becomes eligible for parole.

Often, individuals charged with armed robbery face companion charges for possession of a weapon for an unlawful purpose. This is technically a weapons offense that applies in certain cases wherein a person possesses a weapon with the purpose to commit another crime against a person or property. Possession of a firearm to commit a robbery, as in this case, is a second degree crime under N.J.S.A. 2C:39-4. In firearms cases such as these, the defendant also faces a mandatory minimum sentence under New Jersey’s Graves Act.
