Plainsboro NJ DWI Arrest on July 4
In a recent NJ.com article, a 29-year-old Ewing Township woman was arrested and charged with Driving While Intoxicated in Plainsboro Township on Route 1 at 4:30 a.m. on July 4. The arresting officer engaged in the initial traffic stop of the driver when he observed her vehicle travelling 97 miles per hour in a 55 MPH zone. Once the officer pulled her over, he approached the vehicle and will testify that he had reasonable suspicion that the driver was intoxicated. A subsequent Standardized Field Sobriety Test and administration of the Alcotest 7110 (New Jersey’s version of the Breathalyzer) led the Plainsboro Police Department to charge her with Driving While Intoxicated, Reckless Driving, Speeding, Failure to Maintain Lane, and Failure to Produce a Driver’s License.
In New Jersey, a driver can be charged with a DWI after an officer has probable cause to conduct a traffic stop. In the case at hand, the woman’s speeding provided the officer with probable cause. Furthermore, the officer must be able to demonstrate a “reasonable, articulable suspicion” that the driver is intoxicated in order to administer the standardized field sobriety test. The results of that test, if indicative of intoxication, then provide an arresting officer with sufficient probable cause to arrest the driver and bring to the police station in order to administer the Alctotest to gauge the suspect’s BAC%.

Such charges carry severe penalties, including a 7-12 month loss of license, hundreds in surcharges, community service, and mandatory drug and alcohol counseling. In the case at bar, the woman’s reckless driving charges will likely be accompanied by 5 points. The high-grade speeding charge (42 MPH over the limit) will also likely add 5 points to her abstract.
